This first volume in the four-volume series The Moral Limits of the Criminal Law focuses on the "harm principle," the commonsense view that prevention of harm to persons other than the perpetrator is a legitimate purpose of criminal legislation. Feinberg presents a detailed analysis of the concept and definition of harm and applies it to a host of practical and theoretical issues, showing how the harm principle must be interpreted if it is to be a plausible guide to the lawmaker.

"This is one of the most important efforts to analyze Miil's harm principle in order to articulate a politically liberal conception of criminal law. It's great flaw is that, in order to stretch the harm principle far enough to include everything Feinberg thinks ought to be criminalized and exclude everything he thinks ought not to be criminalized, Feinberg fashions a principle which has little connection with what Mill said and what others who speak of the harm principle mean. What Feinberg really shows, without admitting it or even seeing it, is that Mill's harm principle is unworkable. Nonetheless, this book is a classic."
